Senate confirms Lew as next Treasury Secretary

The Senate has confirmed Jack Lew, a former budget director and chief of staff to the president, as the next secretary of the treasury.

The vote was 71 to 26.

Lew's critics said he failed to adequately explain why he received a hefty severance package when he voluntarily left his job as an executive vice president at New York University.

Lew left the school in 2006 to take a position at Citigroup Inc., a post that some said made him too cozy with big banks.?

But foes failed to muster enough opposition to prevent the wonky former Office of Management and Budget chief from ascending to the Treasury Department job -- one that sits at the center of debate over the nation's spending and debt.

By a vote of 19 to 5, the Senate Finance Committee voted Tuesday to recommend Lew for a full Senate vote.

All five of the votes against him came from Republican committee members; six Republicans on the committee supported him.

Lew, a native of New York City, began his career in Washington in 1973 serving as a legislative aide. He went on to spend nine years as chief domestic policy adviser to House Speaker Tip O'Neill.

He most recently served as the president's chief of staff, a post he took in January 2012.

Lew accumulated minor Twitter fame for his cartoonishly illegible signature, which by law will appear on U.S. bills.

The president himself poked fun at Lew's penmanship upon making the nomination, saying that his pick had promised to make at least one letter of his signature legible "in order not to debase our currency."

A new climate model predicts an increase in snowfall for the Earth's polar regions and highest altitudes, but an overall drop in snowfall for the globe, as carbon dioxide levels rise over the next century.

The decline in snowfall could spell trouble for regions such as the western United States that rely on snowmelt as a source of fresh water.

The projections are the result of a new climate model developed at the National Oceanic and Atmospheric Administration (NOAA) Geophysical Fluid Dynamics Laboratory (GFDL) and analyzed by scientists at GFDL and Princeton University. The study was published in the Journal of Climate.

The model indicates that the majority of the planet would experience less snowfall as a result of warming due to a doubling of atmospheric carbon dioxide. Observations show that atmospheric carbon dioxide has already increased by 40 percent from values in the mid-19th century, and, given projected trends, could exceed twice those values later this century. In North America, the greatest reductions in snowfall will occur along the northeast coast, in the mountainous west, and in the Pacific Northwest. Coastal regions from Virginia to Maine, as well as coastal Oregon and Washington, will get less than half the amount of snow currently received.

In very cold regions of the globe, however, snowfall will rise because as air warms it can hold more moisture, leading to increased precipitation in the form of snow. The researchers found that regions in and around the Arctic and Antarctica will get more snow than they now receive.

The highest mountain peaks in the northwestern Himalayas, the Andes and the Yukon region will also receive greater amounts of snowfall after carbon dioxide doubles. This finding clashes with other models which predicted declines in snowfall for these high-altitude regions. However, the new model's prediction is consistent with current snowfall observations in these regions.

The model is an improvement over previous models in that it utilizes greater detail about the world's topography the mountains, valleys and other features. This new "high-resolution" model is analogous to having a high-definition model of the planet's climate instead of a blurred picture.

The study was conducted by Sarah Kapnick, a postdoctoral research scientist in the Program in Atmospheric and Oceanic Sciences at Princeton University and jointly affiliated with NOAA's Geophysical Fluid Dynamics Laboratory in Princeton, and Thomas Delworth, senior physical scientist at GFDL.

The paper, "Controls of Global Snow Under a Changed Climate," was published online by the Journal of Climate Feb. 6.

Five biggest moments from ?The Ultimate Fighter?

This week's episode of "The Ultimate Fighter" involved some easygoing discussion between Jon Jones and Chael Sonnen, charades, and a star (?) of the silver screen. Here are the biggest moments.

Cool, laid-back moment between Sonnen and Jones. Though their trash talk has been a centerpiece of promoting their fight, Sonnen and Jones became two coaches at the training center. They may be adversaries, but anyone who has been around coaches recognized their words as just two coaches shooting the breeze. Later, Sonnen starts his shtick again, but it's just so fun to see him as a coach.

Charades. It turns out Chael Sonnen and his fighters are pretty good at charades. Who woulda thunk it?

Mickey Rourke! Because of Sonnen's asking -- or threats, depending on who is talking -- actor and former boxer Mickey Rourke talked to Team Sonnen. He spoke with the fighters about how to overcome adversity. If there's anyone who knows about that, it's Mickey Rourke.

That fight: The bout between Bubba McDaniel and Kelvin Gastelum turned into a really fun grapplefest in the first round. McDaniel and Gastelum changed positions several times, and both went for submissions. But it was Team Sonnen's Gastelum who walked away with the win after getting a tight rear naked choke on McDaniel in the second.

Better than a call from the president: Gastelum is a huge Ronda Rousey fan, and Sonnen set up a call between the victorious fighter and the UFC women's bantamweight champ. Not a bad day.

Mutant champions save imperiled species from almost-certain extinction

Feb. 19, 2013 ? Species facing widespread and rapid environmental changes can sometimes evolve quickly enough to dodge the extinction bullet. Populations of disease-causing bacteria evolve, for example, as doctors flood their "environment," the human body, with antibiotics. Insects, animals and plants can make evolutionary adaptations in response to pesticides, heavy metals and overfishing.

Previous studies have shown that the more gradual the change, the better the chances for "evolutionary rescue" -- the process of mutations occurring fast enough to allow a population to avoid extinction in changing environments. One obvious reason is that more individuals remain alive when change is gradual or moderate, meaning there are more opportunities for a winning mutation to emerge.

Now University of Washington biologists using populations of microorganisms have shed light for the first time on a second reason. They found that the mutation that wins the race in the harshest environment is often dependent on a "relay team" of other mutations that came before, mutations that emerge only as conditions worsen at gradual and moderate rates.

Without the winners from those first "legs" of the survival race, it's unlikely there will even be a runner in the anchor position when conditions become extreme.

"That's a problem given the number of factors on the planet being changed with unprecedented rapidity under the banner of climate change and other human-caused changes," said Benjamin Kerr, UW assistant professor of biology.

Kerr is corresponding author of a paper in the advance online edition of Nature the week of Feb. 9.

Unless a species can relocate or its members already have a bit of flexibility to alter their behavior or physiology, the only option is to evolve or die in the face of challenging environmental conditions, said lead author Haley Lindsey of Seattle, a former lab member. Other co-authors are Jenna Gallie, now with ETH Zurich, the Swiss Federal Institute of Technology, and Susan Taylor of Seattle.

The species studied was Escherichia coli, or E. coli, a bacterium commonly found in the lower intestine and harmless except for certain strains that cause food-poisoning sickness and death in humans. The UW researchers evolved hundreds of populations of E.coli under environments made ever more stressful by the addition of an antibiotic that cripples and kills the bacterium. The antibiotic was ramped up at gradual, moderate and rapid rates.

Mutations at known genes confer protection to the drug. Researchers examined these genes in surviving populations from gradual- and moderate-rate environments, and found multiple mutations.

Using genetic engineering, the scientists pulled out each mutation to see what protectiveness it provided on its own. They found some were only advantageous at the lower concentration of the drug and unable to save the population at the highest concentrations. But those mutations "predispose the lineage to gain other mutations that allow it to escape extinction at high stress," the authors wrote.

"That two-step path leading to the double mutant is not available if a population is immersed abruptly into the high-concentration environment," Kerr said. For populations in that situation, there were only single mutations that gave protection against the antibiotic.

"The rate of environmental deterioration can qualitatively affect evolutionary trajectories," the authors wrote. "In our system, we find that rapid environmental change closes off paths that are accessible under gradual change."

The work was funded by the National Science Foundation, including money through the consortium known as the Beacon Center for the Study of Evolution in Action, and UW Royalty Research Funds.

The findings have implications for those concerned about antibiotic-resistant organisms as well as those considering the effects of climate and global change, Kerr said. For instance, antibiotics found at very low concentrations in industrial and agricultural waste run-off might be evolutionarily priming bacterial populations to become drug resistant even at high doses.

As for populations threatened by human-caused climate change, "our study does suggest that there is genuine reason to worry about unusually high rates of environmental change," the authors wrote. "As the rate of environmental deterioration increases, there can be pronounced increases in the rate of extinction."

Economic review finds Detroit unable to fix budget woes

Motown is singing a sad, sad tune.

An economic review team painted a bleak picture of Detroit's economic outlook?on Tuesday, sending a report to Michigan Gov. Rick Snyder that declared the city is in "a financial emergency" that it is unable to fix.

The six-person state team tasked to comb through Detroit's finances has unanimously?concluded that the city needs outside assistance to right its economic woes and become solvent again.

"We believe there is a financial emergency in the city and that there is no plan in place to correct the situation," Michigan State Treasurer Andy Dillon said at press conference Tuesday afternoon.?

The group's findings were sent on Tuesday to Snyder, who now has 30 days to either accept or reject the conclusion. It is likely the governor will appoint an emergency financial manager to head the effort of turning Detroit's financial situation around.

The report found the Motor City faces a?cumulative cash deficit of more than $100 million by June 30, 2013 if? "significant spending cuts" are not made. Detroit has $14 billion in employee retirement liabilities and unfunded pensions, and will need $1.9 billion over the next five years to pay off other long-term liabilities. The city has been running deficits every year since 2005, according to the review team.

The city's population, and with it its tax base, has plunged in recent decades. ?Detroit has been hit hard by the decline of the auto industry, foreclosures and crime -- all factors that have played a part in its economic misfortunes. "While we all know there is financial strain in the city, there is also not an ability or a mechanism in place for the city to address it absent of a?finding?of emergency," said Dillon.

A large portion of the review was focused on?Detroit's?200-page charter, which the economic team found was preventing the city from making the necessary changes. The final report also said the city's bureaucracy is too inflexible to make the?meaningful?changes that would be necessary to change course.?

Dillon said the state has given Detroit opportunities to get their fiscal house in order, but city?official?have failed to do so.?"We gave the city every chance to avoid the outcome that we're recommending to the governor today," he said. ?In a statement the treasurer said "key reform measures have not occurred quickly enough, if at all."

Still, members of the review team present at Tuesday's news conference were optimistic that things could be fixed in what was once one of America's top city's.??

"A lot of the ingredients for the turnaround of the city are in place," said?Frederick Headen, legal advisor for the Michigan Department of Treasury?and member of the review panel. "Now we just need to execute and I do believe strongly that Detroit is fixable."

British police mount raid as horsemeat scandal widens

LONDON (Reuters) - British police and regulators raided a slaughterhouse and a meat processor on Tuesday suspected of selling horsemeat as beef, expanding a Europe-wide scandal that has shocked consumers and exposed flawed food safety controls.

In Paris, French prosecutors opened a preliminary judicial investigation to determine whether fraud was committed in the growing scandal.

The prosecutor's office said a judicial inquiry had been opened in the northeastern city of Metz on Monday, but subsequently it was transferred to Paris, where national issues of food security are investigated.

In Britain, the raids on companies were the first by officials investigating horsemeat supplies in a country where the issue has angered consumers and led to several big retailers pulling contaminated products from their shelves.

While it is not illegal to sell horsemeat in Britain, eating it is virtually taboo. The British government said anyone found to have fraudulently sold horsemeat should be prosecuted.

"It is totally unacceptable if any business in the UK is defrauding the public by passing off horsemeat as beef," Britain's Environment Secretary Owen Paterson said. "I expect the full force of the law to be brought down on anyone involved in this kind of activity."

The Food Standards Agency, the British regulator, said it had suspended operations at an abattoir in northern England and a meat processing company in Wales while it investigates whether they were involved in horsemeat being missold as beef for kebabs and burgers.

The scandal, affecting a growing number of European countries and retailers, began in Ireland when horsemeat was found in frozen beef burgers. The inquiry has implicated companies across Europe, from France and the Netherlands to Cyprus and Romania.

Britain's Paterson is due to meet European Union officials in Brussels on Wednesday to discuss the issue.

The issue came to light on January 15 when routine tests by Irish authorities discovered horsemeat in beef burgers made by firms in Ireland and Britain and sold in supermarket chains including Tesco, Britain's biggest retailer.

Concern grew last week when the British unit of frozen foods group Findus began recalling its beef lasagne on advice from its French supplier, Comigel, after tests showed concentrations of horsemeat in a range from 60 to 100 percent.

MEATBALLS WITHDRAWN

In a separate development on Tuesday, upmarket British retailer Waitrose, part of the John Lewis group, withdrew packs of frozen beef meatballs after tests suggested they might contain pork.

"The meatballs are safe to eat but pork is not listed as an ingredient and should not be part of the recipe," it said.

Rogue suppliers are suspected of trying to increase their margins by passing off cheap horsemeat as more expensive beef.

Food experts say globalization has helped the industry grow, but has also created a complex system which has fuelled the risk of adulteration through neglect or fraud.

Mark Woolfe, a former senior food safety official, said the European Commission's decision to reclassify a product which closely resembled mince as "mechanically separated meat" had forced suppliers to seek cheaper alternatives.

"Manufacturers who were using that for value products had to leave the UK food chain and go and look at overseas suppliers at a price similar to desinewed meat or even lower," he said.

In France, frozen food seller Picard became the latest French retailer to recall lasagne and other meals from its stores on Tuesday after discovering horsemeat in packaged foods advertised as beef.

An initial investigation by French authorities revealed that the horsemeat that made its way throughout the supply chain to Britain and France originated from a Romanian abattoir.

On Monday, Romania's prime minister denied that any Romanian companies had committed fraud in the affair.

More cases are expected to emerge during tests on processed beef products in Britain, with results due on Friday.

NATO airstrike kills 10 civilians, Afghans say

KABUL, Afghanistan (AP) ? A NATO airstrike struck two houses, killing 10 Afghan civilians and four insurgents near the Pakistani border, officials said Wednesday. President Hamid Karzai condemned the attack, the latest in a series of civilian casualty reports that have raised tensions between the Afghans and the U.S.-led foreign forces.

The attack occurred about 10 p.m. Tuesday during a joint NATO-Afghan operation in the Shigal district of Kunar province, a lawmaker from the area said. The U.S.-led military alliance in Kabul said only that it was looking into the reports.

Wagma Sapay, a member of parliament from Kunar, said the civilians killed were in one house while four senior Taliban leaders were slain as they were gathering next door in the Chawkam area.

Karzai's office said 10 civilians, including women and children were killed, and four were wounded. It said a delegation was sent to the site to investigate.

The statement said Karzai "strongly condemns" the airstrike and "emphasizes that the fight against terrorism is not in the house and villages of Afghan people."

Provincial police chief Ewaz Mohammad Naziri said those killed included five boys, four women and one man.

The governor of Kunar, Sayed Fazelullah Wahidi, said the local government had not been informed about plans for the strike.

"This operation was by coalition and Afghan forces," he said. "We were not aware of it."

The killing of civilians at the hands of U.S. and other foreign forces has been one of the most contentious issues in the 11-year war.

Jamie Graybeal, a spokesman for the International Security Assistance Force, said the alliance was aware of the allegations of civilian casualties in Kunar but could not confirm any details.

"We take these allegations very seriously and we are in the process of determining the circumstances surrounding this incident," he said.

The reported attack came as President Barack Obama announced in his State of the Union speech that he will bring home within a year about half of the 66,000 U.S. troops now in Afghanistan in a step toward withdrawing all foreign combat forces by the end of 2014.

The U.N. body monitoring the rights of children said last week that attacks by U.S. military forces in Afghanistan, including airstrikes, have reportedly killed hundreds of children over the last four years.

The Geneva-based Committee on the Rights of the Child said the casualties were "due notably to reported lack of precautionary measures and indiscriminate use of force."

ISAF, which is composed mainly of American forces, dismissed that claim, saying that it takes special care to avoid civilian casualties.

"Midnight Express" editor Gerry Hambling dead at 86

LOS ANGELES (TheWrap.com) - Gerry Hambling, the British film editor whose credits include "Midnight Express," "Pink Floyd: The Wall" and "Mississippi Burning," died February 5 in England. He was 86.

Hambling, who entered the film industry at 16 as an editor's apprentice, was a longtime collaborator of director Alan Parker, editing 14 of his films.

"He was undoubtedly one of the finest film editors that the British film industry has produced," Parker remembered.

John Grover, vice chairman of the Guild of British Film Editors, which Hambling helped found in 1966, remembered Hambling as a man of "warmth and understanding."

"He was a hard working technician who loved loud music and fast action sequences; he was rather hard on equipment but never got used to editing electronically as he preferred to handle film, something he could ?see and feel,'" Grover said. "He will be missed by friends and colleagues for his warmth and understanding. It was an honor to have known him."

Hambling won three BAFTA Awards, and received the Career Achievement Award from the American Cinema Editors in 1998. He had also been nominated for six Oscars.

Hambling's last editing job was on the 2003 Parker drama "The Life of David Gale," starring Kate Winslet and Kevin Spacey.

Hambling died in Burwell, Cambridgeshire.

    Microsoft's Surface: Wifi updates, pen improvements, more cover colors in pipeline

    New tidbits about what's coming for Microsoft Surface RT and Pro devices are continuing to trickle out. Here are a few additional ones worth mentioning from various places around the Web.

    Wifi updates coming for Surface RT: As Microsoft execs mentioned during a recent Reddit Ask Me Anything Q&A, Microsoft is planning to roll out two additional sets of fixes meant to improve "Wifi connection robustness" on Surface RT devices. The first fix will be delivered tomorrow, February 12, which is Patch Tuesday. Another is set for March 12, according to company officials.

    Surface end-of-support date: 2017: Mainstream, free support for Surface RT devices ends on April 11, 2017, and for Surface Pro devices on July 10, 2017, as Neowin reported recently. Windows 8 Pro's mainstream support ends on January 9, 2018; extended (paid) support ends January 10, 2023. (There is still no date from Microsoft as to when support will end for Windows RT.)

    Warranties for the Surface RT and Surface Pro:?Surface RT and Surface Pro both come with "at least" a one-year warranty, a Microsoft spokesperson confirmed. (Some countries require two-year-minimum warranty.) Microsoft also offers for purchase from Microsoft?an additional "Microsoft Complete" extended service plan?that is different from the base-level warranty for these devices. Complete must be purchased within 45 days of the date of device purchase.

    Surface RT trade-in program? "There is no hardware trade-in or upgrade program at this time," company officials said during last week's Reddit session. "We are confident people will love the devices they purchase but if there are any issues that arise we have a 14 day in-store return policy and a 30 day online store return policy."

    Updates coming for Surface Pro's digitizer pen: After seeing a tweet from PocketNow's Adam Z. Lein about some shortcomings around Surface Pro pen support for certain apps like Photoshop, I asked Microsoft for an update. A spokesperson sent the following:

    "Surface Pro uses Windows Inbox Drivers and APIs (application programming interfaces) for the Surface pen, which support advanced features such as pressure sensitivity and eraser functionality. There are a number of apps in the Store that leverage these new Windows APIs and can take advantage of all that the Surface pen has to offer. The Surface pen does work with Photoshop, which runs on Surface Pro, though advanced features such as pressure sensitivity and eraser functionality may not be available at this time. Microsoft is working with the necessary partners to make advanced features of the Surface pen available across a number of applications in the near future."

    More colors likely coming for Surface covers: Microsoft's Touch covers come in a handful of colors (black, white, red, magenta and cyan), but its Type cover currently comes in black only. During last week's Reddit Q&A, when asked whether there would be more colors coming for both kinds of covers, the Surface Team responded said there would be more Touch cover colors coming "soon" and that colorful Type covers will be "likely will over time." (No one asked if Microsoft planned to make the Surfaces themselves in different colors, as my ZDNet colleague Matthew Baxter-Reynolds is advocating.)

    Will Microsoft make Surface Pro and/or RT on volume-license contracts: "Outside of what we?ve already publicly shared in regards to pricing, don?t have anything else to add," a spokesperson said.

    Microsoft has made available for download a 68-page "Getting Started" guide for the Surface RT and Pro devices, which includes all the navigational and basic how-tos for those with both kinds of PC/tablet hybrids.     Samsung Galaxy Note 8.0 to land in Wi-Fi, 3G and 4G forms

    A trio of Samsung Galaxy Note 8.0 variants are to be released, latest reports surrounding the heavily rumoured stylus-friendly tablet have suggested.

    Widely expected to be heading for an official unveiled at MWC 2013 later this month, latest reports have suggested that a hat-trick of Samsung Galaxy Note 8.0 tablets will be launched, with Wi-Fi only, 3G and 4G variants to be made available.

    According to leaked product reference numbers, the Samsung Galaxy Note 8.0 will see wannabe owners able to choose from a selection of connectivity options with the Wi-Fi only variant of the 8-inch device (GT-N5100) to line up alongside more costly Wi-Fi plus 3G (GT-N5110), and Wi-Fi plus 3G and 4G counterparts (GT-N5105).

    Seemingly set to land alongside the upcoming Samsung Galaxy Note 8.0, the Korean manufacturer has been rumoured to be prepping a revised range of Samsung Galaxy Tab 3 devices, with each 7-inch, 8.9-inch and 10.1-inch option tipped for Wi-Fi only and cellular connectivity renditions.

    With a 1.6GHz quad-core processor rumoured to feature as the tablet?s engine block, recently leaked Samsung Galaxy Note 8.0 specs have suggested the device will play host to 2GB of RAM, 16GB of integrated storage and, as its name suggests, an 8-inch touchscreen display with a 1280 x 800p resolution.

    Completing the Samsung Galaxy Note 8.0 features list, the mid-sized tablet is expected to sport a 5-megapixel rear-mounted camera.

    (AP) ? At least 10 people were killed and a dozen more injured Sunday after a stampede broke out at a train station in the northern Indian town where millions of devout Hindus gathered for a religious festival, a senior government minister said.

    Pawan Bansal, India's Railway Minister, told reporters that the stampede took place as massive crowds flooded the Allahabad train station on Sunday evening.

    At least two television channels, NDTV and CNN-IBN said as many as 20 people were feared dead and 30 others injured. News reports said the large crowds caused a section of a footbridge at the station to collapse leading to the accident.

    News reports said tens of thousands of people were at the train station at the time. Television showed large crowds pushing and jostling at the train station as policemen struggled to restore order.

    "There was complete chaos. There was no doctor or ambulance for at least two hours after the accident," an eyewitness told NDTV news channel.

    An estimated 30 million devotees were expected to take a dip at the Sangam, the confluence of three rivers ? the Ganges, the Yamuna and the mythical Saraswati ? on Sunday, one of the holiest bathing days of the Kumbh Mela, or Pitcher Festival. The festival lasts 55 days and is one of the world's largest religious gatherings.

    The auspicious bathing days are decided by the alignment of stars, and devout Hindus believe a dip in the sacred river on one of these days will wash away their sins and free them from the cycle of death and rebirth.

    The festival brings together millions of devout worshipers and thousands of religious leaders and ascetics.

    The most dramatic feature of the festival is the Naga sadhus ? ascetics with ash rubbed all over their bodies, wearing only marigold garlands ? leaping joyfully into the holy waters.

    According to Hindu mythology, the Kumbh Mela celebrates the victory of gods over demons in a furious battle over nectar that would give them immortality. As one of the gods fled with a pitcher of the nectar across the skies, it spilled on four Indian towns_Allahabad, Nasik, Ujjain and Haridwar.

    The Kumbh Mela is held four times every 12 years in those towns. Hindus believe that sins accumulated in past and current lives require them to continue the cycle of death and rebirth until they are cleansed. If they bathe at the Ganges on the most auspicious day of the festival, believers say they can rid themselves of their sins.
